Collections Agency or Law Firm?

There are many debt collection agencies offering to collect debts. Mainly these agencies will issue Statutory Demands. It is reasonable to ask why you should use a law firm why there are so many collection agencies.

Unlike collection agencies we are a firm of solicitors. We are expert litigators and we know when to use and, crucially when not to use, Statutory Demands. Many collection agencies offer a “one size fits all” approach. Statutory Demands are often used in inappropriate circumstances. We have first-hand experience of successfully setting aside many Statutory Demands served inadvertently by creditors on advice from collection agencies. This results in a cost award being made against the creditor who presented the Statutory Demand. You simply do not want to find yourself in that position.

We can see the recovery through to a conclusion

Collection agencies can send letters, call debtors and serve Statutory Demands. However, collection agencies cannot take any legal process on your behalf. This means that if the debtor doesn’t pay voluntarily then before a Bankruptcy Petition can be issued or County Court proceedings issued (if required) the collection agency will be compelled to send your file to a firm of solicitors.

Debtors respond to solicitors

It is widely known in the collection agencies that debtors respond more positively to communications from solicitors rather than from debt collection agencies. Why is this the case? The answer is simple; debtors know that solicitors’ threats are not empty. We have the authority to issue legal process and we can follow the case through to its conclusion. We are authorised to issue insolvency proceedings, County Court claims and take enforcement action through the Court. Debt collection agencies are simply unable to do this.

 A separate client account and fully regulated

Solicitors are regulated by the Solicitors Regulation Authority. All funds received from debtors are held in a separate client account and your money is always safe with a solicitor. The Solicitors Regulation Authority underwrites all client deposits held with solicitors’ firms in England and Wales without any financial limitation. Quite simply a solicitor’s client account is a safer place for your money than the account of a debt collection agency.
